Trump's Framework of Punishment and Favor

The ex-president's intense urge for payback has swiftly evolved into a structured apparatus. During the twelve months, the leader's rage and whims have assumed the shape of administrative measures in a manner reminiscent to historical authoritarian systems. Justice department figures who do not cooperate are summarily removed and succeeded by devotees. Political officials who challenge him encounter legal action, court proceedings and penalties. Adversaries have been labeled under executive memoranda as “unpatriotic”, “against faith communities” and “against free markets”, and threatened with criminal charges as “extremists”.

Government Institutions Restructured

Every situation involving targeting of Trump's enemies and leniency for supporters exhibits its own particular characteristics. But, regardless of their specific form, they embody expressions of what has emerged as a systematic method. These episodes are far from coincidental. The administration's cleansing of DoJ lawyers and Federal Bureau of Investigation personnel, accompanied by his installation of supporters in high-level posts, commenced rapidly, promptly took on a regularity, and has now been shaped into a regime. DoJ and the FBI have been remade into political agencies under the president's clear orders to execute his directives. Wrongdoing has been turned into normal. This is the system of punishment.

Leadership is more concerned with punishing the chief's supposed enemies than they are with protecting our public welfare.

Within the Structure

The foundation of this system has been exposed in the legal complaint of multiple previous senior Federal Bureau officials filed in the ninth month in the federal court in DC against FBI director Kash Patel and top lawyer another official for illegal termination in “a campaign of revenge against them for what the accused deemed to be a failure to show adequate devotion”. The document states that Brian Driscoll, the previous temporary head, recounts a conversation in which he “freely admitted the impropriety of his actions”.

Driscoll had attempted to defend law enforcement officers from being dismissed, the complaint states. He told him that “they” – perceived by the official to be the White House and federal prosecutors – had directed him to remove everyone who they considered as having participated in a law enforcement case against him. The complaint continues: “Patel stated that he had to fire the individuals his leaders told him to fire, because his chance to keep his own job was contingent on the dismissal of the agents who handled cases involving the leader. He commented that there was no way he or Driscoll could do to halt these or any other terminations, because ‘the bureau attempted to put the chief in jail and he recalls it clearly.’” After Driscoll advised him he was breaking the FBI's own policies, the director supposedly said “he knew that and he knew the essence of the immediate dismissals were likely unlawful”.

Broad Consequences

Following the director's claimed confession to the official, the Department of Justice and the FBI have been dismantled and repurposed for his system of punishment. Several of the agency's senior executives were terminated or compelled to leave in the initial period of the presidency. About numerous professional attorneys at the justice department have accepted a “early exit scheme”. A minimum of several federal prosecutors, among them those in the Manhattan division, quit in protest over what they considered as ideological pressure in abandoning the criminal prosecution against the New York City mayor, a political figure, in as a trade for his cooperation with his ICE arrests of migrants. The public integrity section of the department, which manages corruption cases, has been reduced to a handful of lawyers. The rights protection unit has been devastated: the majority of its staff has resigned. A third of senior leaders at the department have left. The unit upholding ecological regulations has lost a majority its leadership.

Rewards and Sanctions

Concerning the legal matter, the interim prosecutor for the southern district of New York, she, resigned in objection against what she described as the “trade-off”. A key figure, his “immigration leader,” appeared as the enforcer with him on television to declare: “Should he fail to deliver, I'll reappear in the city.”. Additionally, a former official, previously the senior DoJ official and a former Trump attorney, who arranged the deal, was granted an judicial position, a possible pathway to the supreme court.

The president's exemption for offenses carried out while in office, granted by the extraordinary decision of the Republican majority on the judicial body, thus thwarting his legal action over the January 6 insurrection and safeguarding his public standing for the presidential race, is the foundation stone on which he stands to protect his loyalists. With such immunity, he has been empowered to enable wrongdoing. The consequence of the supreme court decision infuses his presidency and the political party thoroughly. The court matter has escalated. As a past leader's legal adviser John Dean remarked about the Watergate
